By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 - PURCHASE AND USE OF PRODUCTS
Any product claims made or product benefits described on this website or otherwise have not been evaluated by the TGA (Therapeutic Goods Administration) or any international equivalent. These products have not been approved by the TGA for therapeutic use and are not intended to treat, cure or prevent any disease or illness. Use only as directed and always consult your physician before use.
Our products are cosmetic topical products. They are not medicines. They are not intended to diagnose, treat, cure, or prevent any disease, illness, or medical condition. If you are experiencing pain, discomfort, or a medical condition, you should consult a qualified healthcare professional. Our products are not a substitute for medical treatment.
All products sold on this website, within Australia or internationally, must be used strictly within your country of origin's hemp ordinances. The customer is entirely responsible for ensuring that our products are within the law of their associated region, state and country. Our products are for "external use" only purposes that also must be "non-therapeutic" for all sales.

SECTION 3 - GENERAL CONDITIONS
We reserve the right to refuse Service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. All transactions are facilitated via credit or debit card by our third-party payment providers. This is collected, stored and encrypted by our third-party payment providers and Chronic bears no responsibility for the use or misuse of this data. We do not store any payment details.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 4 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy.
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 7 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 8 - ORDER ACCEPTANCE
Placement of an order does not constitute acceptance by Chronic Australia. All orders are subject to review, verification, and acceptance at our discretion. An order is only considered accepted once the products have been dispatched from our warehouse. Prior to dispatch, we reserve the right to:

• Cancel all or part of the order;
• Adjust quantities;
• Request additional verification from the customer;
• Refund payment in full without further obligation.

In the event of a pricing error on our website (including products displayed at significantly below cost, or promotions applied in error), we reserve the right to cancel any affected order and refund any payment made, regardless of whether an order confirmation has been issued.

SECTION 9 - SHIPPING AND DELIVERY
Unless otherwise stated, all orders are dispatched from our NSW warehouse within one business day of payment being received. Delivery timeframes provided on our website are estimates only and are not guaranteed. Chronic Australia is not responsible for delays caused by the courier, Australia Post, customs authorities, or other third parties outside our direct control.
Risk of loss for products passes to the customer upon dispatch from our warehouse. Where products are lost or damaged in transit, we will work with the carrier to resolve the issue, however the customer accepts that resolution timeframes are subject to the carrier's processes.
It is the customer's responsibility to provide an accurate shipping address. Orders returned to us due to incorrect addresses, failed delivery, or refusal of delivery may incur a re-shipment fee. Refunds for undelivered orders returned to us will be made at the original product price less any shipping and handling costs incurred.

SECTION 10 - TOPICAL TRIAL PACK
The Topical Trial Pack (also referred to as the "Free Trial Pack") is a promotional offer provided by Chronic Australia to allow new customers to experience sample-sized versions of our topical products. By purchasing or ordering a Topical Trial Pack, you acknowledge and agree to the following terms:

10.1 Nature of the offer
The sample products contained within the Topical Trial Pack are provided free of charge. Customers are only required to pay a shipping and handling fee (currently $16.95 AUD, subject to change without notice). This fee covers the cost of shipping, packaging materials, order handling, and associated staff labour required to dispatch the Trial Pack. The fee is non-refundable once the order has been dispatched.

10.2 No ongoing obligation
Purchasing a Topical Trial Pack does not obligate you to make any further purchases from Chronic Australia. The Trial Pack does not enrol you into any product subscription, membership, or ongoing automatic payment arrangement. You will not be charged any recurring fees as a result of ordering a Trial Pack.

10.3 Eligibility - new customers only
The Topical Trial Pack is available exclusively to new customers of Chronic Australia. A "new customer" is defined as an individual who has not previously placed an order or received a Topical Trial Pack from Chronic Australia. Eligibility is determined at our sole discretion, including (but not limited to) verification against email addresses, shipping addresses, phone numbers, and payment details associated with prior orders.

10.4 One Trial Pack per customer, per lifetime
Each customer is eligible to receive one (1) Topical Trial Pack over the entire lifetime of their relationship with Chronic Australia. Any attempt to order additional Trial Packs - whether through the same account, a different account, or using different contact or shipping details - will be considered a breach of these Terms. We reserve the right to cancel any such orders, refund the shipping fee, and charge the full retail price for the products ordered, plus standard shipping fees, at our discretion.

10.5 Existing customers
If an existing customer (i.e. any customer who has previously placed any order with Chronic Australia, including a prior Trial Pack) attempts to order a Topical Trial Pack, the order will not be fulfilled at the promotional rate. Instead, the customer will be charged at the retail price corresponding to the volume of each sample product included, plus the standard shipping and handling fee. We may either contact the customer for additional payment before dispatch, or cancel and refund the order at our discretion.

10.6 Shipping fee is non-waivable
The shipping and handling fee associated with the Topical Trial Pack is not eligible for waiver under any circumstance, including any promotional free shipping or free express shipping offer that may apply to other items in your order. If a Topical Trial Pack is added to an order containing full-sized products:
- The customer must pay the full shipping and handling fee for the Trial Pack.
- This fee is in addition to any shipping fees applicable to the full-sized products.
- Any free shipping, discounted shipping, or free express shipping promotion applies only to the full-sized products and does not extend to the Trial Pack.

10.7 Domestic orders only
The Topical Trial Pack is only available to customers with an Australian shipping address. International orders, including to New Zealand, the United States, Canada, and all other countries, are not eligible for the Trial Pack offer under any circumstance.

10.8 Exclusion from the 60-day money-back guarantee
Any subsequent purchases made by a customer after receiving a Topical Trial Pack are not eligible for our 60-day money-back guarantee. The exceptions to this exclusion are:

• Products received faulty or not fit for purpose;
  
• Products physically damaged in transit; or
  
• Documented allergic reactions to the product (subject to proof, at our reasonable discretion).
  

This exclusion applies because the Trial Pack is designed to allow customers to sample and assess our products before committing to a full-sized purchase. By ordering a Trial Pack, the customer acknowledges they have had the opportunity to test the products prior to any subsequent purchase.
Due to the nature of our Trial Pack, the associated shipping and handling fee of the trial pack is also not refundable.

10.9 Patch testing and allergic reactions
All customers must perform a patch test before using any product from Chronic Australia, including products received in the Topical Trial Pack. To patch test, apply a small amount of the product to a discreet area of skin (such as the inner forearm) and monitor for any reaction for at least 24 hours before broader application.
Discontinue use immediately if any irritation, redness, itching, swelling, or other adverse reaction occurs. Seek medical advice if symptoms persist or worsen. Chronic Australia accepts no liability for any adverse reaction resulting from failure to patch test, failure to read ingredient lists, or use contrary to the directions on the product packaging.

10.10 Promotional terms subject to change
Chronic Australia reserves the right to modify, limit, suspend, or discontinue the Topical Trial Pack offer (including the shipping and handling fee, the contents of the Trial Pack, and the eligibility criteria) at any time without notice. The terms applicable to your Trial Pack order are those in effect at the time your order is placed.

10.11 Fraud and abuse
We reserve the right to cancel, refuse, or refund any Trial Pack order that we believe, in our sole discretion, has been placed fraudulently, in bad faith, or in breach of these Terms. This includes (but is not limited to) orders using false identities, duplicate accounts, existing customers under a different alias, VPN or proxy services to misrepresent location, or any attempt to resell, repackage, or redistribute the Trial Pack or its contents.

SECTION 11 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

SECTION 12 - THIRD-PARTY LINKS
Certain content, products and Services available via our Service may include materials from third-parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

SECTION 13 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

By submitting a review, testimonial, photograph, video, or any other content to Chronic Australia - whether through our website, email, social media, or direct response to a campaign - you grant Chronic Australia a perpetual, irrevocable, worldwide, royalty-free, transferable licence to use, reproduce, modify, adapt, publish, translate, and display such content across any medium, including marketing materials, website content, product packaging, and social media.
You warrant that:

• The content is your own original work;
  
• You have the right to grant the licence described above;
  
• The content is truthful and reflects your genuine experience;
  
• Your use of our products complied with the directions for use;
  
• The content does not infringe the rights of any third party, including privacy, publicity, or intellectual property rights;

We reserve the right to decline or remove reviews that reference specific medical conditions, therapeutic claims, or content that may breach TGA regulations, without altering the overall sentiment of the review.

Chronic Australia does not frequently monitor these reviews or endorse any claims made. In no case shall Chronic Australia Pty Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Additional limitations specific to our products:
To the maximum extent permitted by law, and subject to the non-excludable consumer guarantees under the Australian Consumer Law:
(a) Our products are cosmetic topical products intended for external use only on healthy, unbroken skin;
(b) You are responsible for reviewing the ingredient list prior to use and ensuring you are not allergic or sensitive to any listed ingredient;
(c) You agree to discontinue use immediately if any adverse reaction occurs, and to seek appropriate medical advice;
(d) We are not liable for any reaction arising from use inconsistent with the directions on the product packaging;
(e) We are not liable for any reaction arising from use by individuals who are pregnant, breastfeeding, under medical treatment, or taking medications, without prior consultation with their healthcare provider;
(f) Where the Australian Consumer Law applies and our liability cannot be excluded, our liability is limited, at our option, to:

• Replacement of the goods or supply of equivalent goods;
  
• Repair of the goods;
  
• Payment of the cost of replacing or repairing the goods; or
  
• Refund of the purchase price paid for the goods.

SECTION 19 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Chronic and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 20 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Products and Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Products and/or Services (or any part thereof).

SECTION 22 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

SECTION 25 - WHOLESALE AGREEMENTS
For all approved wholesale clients and customers, you must agree to adhere to the terms disclosed within this site, as well as the provided wholesale agreements. By signing, acknowledging, or returning our wholesale agreements, you are expressing your consent to these terms. We reserve the right or cancel or terminate any contracts, at any time.
